2. Nature of Our Business

Camera Bazaar primarily deals in pre-owned cameras and photography equipment. We may also offer new products, accessories and other related items from time to time.

Our website serves primarily as a product catalogue and enquiry platform. Customers may view product listings, photographs, descriptions and indicative prices, where provided, and contact us to obtain additional information.

Unless expressly stated otherwise, displaying a product on our website does not guarantee its immediate availability or constitute confirmation of a completed sale.

A purchase is considered accepted when Camera Bazaar confirms the specific product, agreed price, applicable terms and order details in writing, subject to any mandatory rights available to the customer under applicable law.

3. Product Listings and Photographs

We make reasonable efforts to ensure that product descriptions, photographs, specifications and other information are accurate and current.

Pre-owned products: Unless expressly stated otherwise, a product described as "used", "pre-owned" or "second-hand" has been previously owned or used. It may show signs of normal use, including cosmetic wear, scratches, paint loss, dust or other age-related marks.

Actual product photographs: Where photographs are identified as actual product photographs, they are intended to represent the specific unit being offered for sale. Customers should request additional photographs or videos if they require further clarification regarding its condition.

Illustrative photographs: Images identified as illustrative, representative or stock images may not depict the exact unit being sold. The actual product's description and written condition report will apply.

Condition disclosures: Any known material defect, missing accessory, functional limitation or significant cosmetic issue that we identify will be disclosed in the product listing or communicated to the customer before the sale is confirmed.

Minor cosmetic imperfections consistent with the disclosed condition of a pre-owned product shall not, by themselves, constitute a defect or qualify the product for replacement.

Customers are encouraged to inspect the photographs, description, included accessories and condition report carefully before confirming a purchase.

4. Product Enquiries and Purchase Confirmation

Customers may contact us through the website, telephone, email, WhatsApp or another communication channel made available by Camera Bazaar.

During the enquiry process, customers may request additional photographs, videos, specifications, testing information, serial-number verification where appropriate, and clarification regarding the product's condition.

Before confirming a purchase, customers should ensure that they understand:

  • The exact model and unit being purchased.

  • The product's used or new condition.

  • Any disclosed defects, limitations or cosmetic marks.

  • The accessories included in the sale.

  • The final agreed price, taxes and delivery charges.

  • The applicable replacement policy and warranty coverage.

Any quotation or price communicated during an enquiry is subject to the validity period, availability and conditions stated in that quotation.

The final written order confirmation or invoice shall record the agreed product, price and applicable sale terms. Any special commitment made by an authorised representative in writing shall be considered along with these Terms.

5. Prices, Payments and Taxes

All prices shall be communicated in Indian Rupees (INR), unless otherwise specified.

The final payable amount, including applicable taxes, delivery charges and any other disclosed charges, will be communicated before the customer completes the purchase.

Payment must be made through a payment method expressly authorised by Camera Bazaar.

An advance payment, deposit or booking amount, if applicable, shall be governed by the written terms communicated before payment. No amount shall be treated as automatically non-refundable where a refund is required by applicable law or the agreed transaction terms.

Camera Bazaar reserves the right to correct genuine pricing or listing errors before accepting an order. If a pricing error is identified after payment, we will contact the customer and provide an appropriate resolution, including a refund where applicable, rather than unilaterally charging a different price.

A valid invoice or other applicable proof of sale shall be provided in accordance with applicable law.

6. Seven-Day Replacement Policy

Camera Bazaar provides a 7-day replacement policy for eligible products, subject to the following conditions.

6.1 Replacement Period

The customer must notify Camera Bazaar of a replacement claim within seven (7) calendar days from the date the product is delivered to the customer.

The claim must be submitted through [official email/WhatsApp/contact channel], with the order number, a description of the issue and supporting photographs or videos, where reasonably available.

The replacement period is calculated from the recorded delivery date. If a claim is raised within the applicable period, the customer must cooperate with the inspection and return process.

6.2 Eligible Reasons

A replacement may be requested where:

  • The product has a verified functional defect that was present at the time of delivery and was not disclosed before the purchase.

  • The product received is materially different from the product confirmed in the order.

  • A material accessory expressly included in the order is missing.

  • Another circumstance qualifies for a replacement under applicable law or the written order terms.

The issue must be verified through a reasonable inspection and must not arise from an excluded cause described in these Terms.

6.3 Replacement Conditions

To qualify for a replacement, the customer must:

  • Notify us within the applicable seven-day period.

  • Provide the product for inspection in accordance with our return instructions.

  • Return the same product and serial-numbered unit supplied by us.

  • Include the accessories, components and items supplied with the product, except for any item that cannot reasonably be returned due to the verified defect.

  • Take reasonable care of the product while the claim is being assessed.

The product must not have been subjected to unauthorised repair, modification, misuse or avoidable damage after delivery.

A missing original box or packaging will not, by itself, defeat a claim where the claim is otherwise valid under applicable law.

6.4 Inspection and Resolution

Camera Bazaar may inspect the returned product to establish the reported issue and its cause. We may request reasonable supporting information or arrange an inspection by a qualified technician.

Where a replacement claim is approved, we will ordinarily provide a replacement of the same model and substantially equivalent condition, subject to availability and the customer's applicable legal rights.

If an equivalent replacement is unavailable, Camera Bazaar will contact the customer to agree on an appropriate resolution, which may include a refund or another mutually agreed option.

We will not require a customer to accept a different product or store credit in place of a refund where a refund is legally required.

6.5 Exclusions

The replacement policy does not ordinarily cover:

  • Cosmetic marks, scratches, wear or imperfections accurately disclosed before purchase.

  • Damage caused after delivery by accidental impact, dropping, liquid exposure, mishandling or improper storage.

  • Damage caused by unauthorised repairs, modifications or tampering.

  • Issues caused by incompatible accessories, improper installation, incorrect settings or misuse.

  • Normal wear and tear or deterioration arising from ordinary use.

  • A change of mind, a preference for another model, or dissatisfaction with a disclosed characteristic of a pre-owned product.

These exclusions do not apply to the extent that a claim is covered by a mandatory consumer right or concerns a material defect or misrepresentation that was not properly disclosed.

7. Thirty-Day Limited Warranty

Eligible camera bodies sold by Camera Bazaar are covered by a 30-day limited warranty, beginning on the date of delivery, unless a different warranty period is expressly stated in writing.

This warranty is provided by Camera Bazaar and is separate from any manufacturer's warranty that may remain valid.

7.1 What Is Covered

The limited warranty covers verified functional defects in the camera body that:

  • Arise from a fault that existed at the time of delivery;

  • Were not disclosed to the customer before the sale; and

  • Are reported during the applicable warranty period.

Coverage is limited to the camera body and the specific functions expressly covered in the order confirmation or warranty document.

7.2 What Is Not Covered

The following items and circumstances are excluded from Camera Bazaar's 30-day limited warranty:

Battery and charger: Batteries, charging adapters, chargers, charging cables and other power accessories are not covered by this limited warranty, unless expressly stated in writing or required by applicable law.

Physical damage: Damage caused by dropping, impact, crushing, liquid or moisture exposure, corrosion, mishandling, improper storage or other physical damage occurring after delivery is not covered.

Other exclusions:

  • Normal wear and tear, ageing and deterioration consistent with the product's disclosed used condition.

  • Cosmetic marks, scratches, dents, paint wear or other disclosed imperfections.

  • Damage or malfunction resulting from unauthorised repairs, servicing, modification or tampering.

  • Damage caused by incompatible accessories, incorrect voltage, improper connections or misuse.

  • Faults caused by software, firmware, memory cards, lenses or third-party accessories, unless the fault is attributable to a covered defect in the camera body.

  • Sensor dust, ordinary cleaning requirements and maintenance issues, unless expressly identified as a covered defect.

  • Consumable parts and accessories not expressly included in the warranty.

  • Defects specifically disclosed and accepted by the customer before purchase.

7.3 Warranty Claim Procedure

The customer must contact Camera Bazaar within the 30-day warranty period and provide the order number, a description of the fault and reasonable supporting evidence.

The product may be required to undergo inspection by Camera Bazaar or a technician designated by us.

If the fault is covered, Camera Bazaar may, as appropriate, arrange repair or replacement. If the covered fault cannot reasonably be remedied, or applicable law requires another remedy, an appropriate refund or other remedy will be provided.

No repair, replacement or refund is guaranteed for a fault that is reasonably established to have resulted from an excluded cause.

7.4 Warranty Limitations

The limited warranty is applicable only to the product and original transaction identified in the invoice. It may not be transferred to another person without our written consent, except where such restriction is prohibited by applicable law.

The warranty does not extend the original warranty period merely because the product has been inspected or repaired. Any additional warranty coverage provided with a replacement or repair will be communicated in writing.

Nothing in this section limits any statutory consumer rights that cannot lawfully be excluded.

8. Returns, Refunds and Cancellations

Camera Bazaar does not offer an unconditional change-of-mind return policy for pre-owned products, unless such a policy is expressly stated in writing for a particular sale.

However, this does not exclude returns, replacements, refunds or other remedies required under applicable law or expressly agreed in the order confirmation.

A customer wishing to cancel an order before dispatch should contact us as soon as possible. We will confirm whether the order can be cancelled and whether any payment is refundable under the applicable terms.

Where a product is defective, materially misdescribed, incorrect, not delivered as agreed, or otherwise qualifies for a remedy under applicable law, the customer may request an appropriate resolution.

Approved refunds will ordinarily be processed through the original payment method, where feasible, or through another lawful method agreed with the customer. Processing times may depend on the payment provider or bank.

Any deduction from a refund must be lawful, reasonable and disclosed where required. Camera Bazaar will not impose an arbitrary deduction or refuse a legally required refund.

9. Shipping, Delivery and Risk

Delivery estimates are provided in good faith and may be affected by courier operations, weather, strikes, logistical disruptions or other circumstances beyond our reasonable control.

Camera Bazaar will communicate material delivery delays where reasonably practicable.

Customers should provide an accurate delivery address and contact number. Additional delivery attempts or address changes may incur charges where those charges are communicated and agreed in advance.

Upon delivery, customers are encouraged to inspect the package for visible damage and report any concerns promptly. Photographs or an unboxing video can assist in resolving transit-damage claims.

The absence of an unboxing video shall not, by itself, automatically invalidate a claim or any right available under applicable law.

Risk of loss or damage during delivery shall be determined in accordance with the agreed delivery terms and applicable law. Camera Bazaar will reasonably assist customers in pursuing claims for damage or loss occurring during shipping.

10. Product Testing and Used Equipment

Pre-owned cameras may have a history of use, servicing or component replacement. Any known material history that we represent as relevant to the sale will be disclosed where reasonably ascertainable.

Unless expressly confirmed in writing, Camera Bazaar does not guarantee that a used camera is in factory-new condition, retains its original manufacturer's warranty, or includes every accessory originally supplied by the manufacturer.

Customers should independently verify compatibility with their existing lenses, batteries, memory cards, computers and other equipment before purchase.

Any testing information, shutter-count reading, battery-health indication or other technical measurement provided by Camera Bazaar is based on the information or testing reasonably available to us at the time. Such measurements may vary depending on the testing method or subsequent use.

We will not knowingly misrepresent the condition, authenticity or material characteristics of a product.

11. Customer Responsibilities

Customers agree to:

  • Provide accurate contact, billing and delivery information.

  • Use the website and communication channels lawfully.

  • Refrain from fraudulent payment activity, false claims or deliberate damage to products.

  • Keep order confirmations, invoices and relevant communications.

  • Follow reasonable instructions for product inspection, return shipping and warranty assessment.

  • Ensure that any person receiving the product on their behalf is authorised to do so.

Camera Bazaar reserves the right to decline or cancel a transaction where there is a reasonable, documented concern regarding fraud, payment failure, product availability or a material error, subject to applicable law and appropriate refund obligations.

12. Authenticity, Ownership and Serial Numbers

Camera Bazaar will take reasonable steps to ensure that products offered for sale are lawfully sourced and that material representations regarding authenticity are accurate.

Where a product's authenticity is specifically represented by us, that representation forms part of the sale.

Customers must not remove, alter or tamper with serial numbers, identification labels or other identifying marks.

A claim involving suspected counterfeit, stolen or unlawfully altered equipment will be investigated appropriately. Nothing in these Terms restricts a customer's legal rights concerning authenticity or ownership.

13. Website Content and Intellectual Property

Unless otherwise stated, the website's branding, logo, design, written descriptions and original photographs are owned by or licensed to Camera Bazaar.

Visitors may view and use website content for personal, non-commercial purposes relating to product enquiries and purchases.

No person may reproduce, distribute, commercially exploit or use our original content without prior written permission, except as permitted by law.

Product names, logos and trademarks belonging to manufacturers remain the property of their respective owners. Their appearance on our website does not imply sponsorship, endorsement or affiliation unless expressly stated.

14. Website Availability and Third-Party Services

We aim to keep the website accessible and accurate, but uninterrupted availability cannot be guaranteed.

The website may contain links to third-party websites, payment services, courier services or communication platforms. Their services are governed by their own terms and policies.

Camera Bazaar is not responsible for the independent content or availability of third-party websites, although this does not exclude responsibility that may arise under applicable law.

We may update website content, correct errors or temporarily suspend parts of the website for maintenance, security or operational reasons.

15. Limitation of Liability

To the extent permitted by applicable law, Camera Bazaar shall not be liable for indirect or consequential losses arising from a customer's inability to use the website, an interruption in website availability, or the customer's use of equipment in a manner inconsistent with its intended purpose.

Camera Bazaar shall not be responsible for losses caused by misuse, unauthorised modification, improper installation or failure to follow reasonable product instructions, where such loss is attributable to the customer's conduct.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury where such exclusion is unlawful, or any other liability or consumer remedy that cannot legally be excluded or limited.

No provision in these Terms shall be interpreted as permitting Camera Bazaar to avoid responsibility for a product defect, misrepresentation, breach of an express commitment or other liability established under applicable law.

16. Indemnity

To the extent permitted by law, a customer shall be responsible for direct losses and reasonable costs suffered by Camera Bazaar to the extent caused by the customer's fraud, unlawful conduct, deliberate misuse of the website or infringement of our intellectual property rights.

This clause does not require a customer to indemnify Camera Bazaar for our own unlawful conduct, negligence where liability cannot be excluded, or any matter for which the customer cannot lawfully be held responsible.

17. Privacy and Personal Information

Personal information collected during enquiries, purchases, delivery, payments and after-sales support will be handled in accordance with our Privacy Policy and applicable data-protection laws.

We will use customer information for legitimate business purposes, including processing enquiries and orders, arranging delivery, providing warranty support, preventing fraud and complying with legal obligations.

Please read our [Privacy Policy] for further information about the collection, use, storage and sharing of personal information.

19. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, disputes shall be submitted to the competent courts having jurisdiction over [Vadodara, Gujarat / the appropriate business location].

Nothing in this clause restricts a consumer from approaching a consumer commission or other authority that has jurisdiction under applicable law.

20. Changes to These Terms

Camera Bazaar may update these Terms from time to time to reflect changes in its business practices, products or applicable law.

The updated version will be published on the website with a revised "Last Updated" date.

Changes will apply prospectively, unless a different application is required or permitted by law. The terms applicable to an already confirmed order will not be altered retrospectively to remove an existing customer right or a specific commitment made in writing.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be interpreted or limited to the extent necessary to make it enforceable, where legally permissible.

The remaining provisions shall continue to apply to the extent that they remain valid and enforceable.

22. Entire Agreement

These Terms, together with the relevant product listing, written order confirmation, invoice, applicable warranty terms, replacement policy and Privacy Policy, constitute the agreement governing the relevant transaction.

If a specific written order confirmation expressly provides a different term for that transaction, the specific term shall prevail to the extent of the inconsistency, subject to applicable law.

Nothing in these Terms is intended to exclude any right or remedy that cannot lawfully be excluded.
